1. Acceptance of terms
By accessing or using Archivarix Echo ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.
2. Service description
Archivarix Echo is an independent research and archival meta-search tool. It provides a single search interface over publicly available web archives and open datasets: including the Internet Archive (Wayback Machine), archive.today, Common Crawl, scholarly indexes, book libraries, and many subject-specific archives. The Service does not host, store, reproduce, or distribute the underlying archived content. It detects the kind of identifier you submit, queries third-party archives that already make that data public, and links you to the results. Every result points back to the archive that holds the copy.
3. User accounts
You may create a free account to unlock higher daily limits and to save your search history. You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it current. We may suspend or terminate accounts that violate these Terms.
4. Acceptable use
You agree not to: (a) use the Service for any purpose that violates applicable law; (b) attempt to circumvent rate limits, access controls, or other technical restrictions; (c) scrape, crawl, or access the Service through automated means beyond normal browser use without prior written permission; (d) interfere with the operation of the Service or with other users' access; (e) use data obtained through the Service to harass, stalk, or harm any person; (f) misrepresent your identity or affiliation; or (g) redistribute or commercially exploit data obtained through the Service in bulk without permission.
5. Third-party archives
The Service links to and queries archives and datasets operated by third parties. Those archives have their own terms of use, rate limits, and legal frameworks, which apply when you access them. We do not control their availability, accuracy, or content, and we are not responsible for it. When you follow a result, you leave Echo and are subject to the destination's own terms.
6. Intellectual property
The Service's source code, design, branding, and original content are the property of Archivarix. Metadata, snapshots, and other material surfaced through the Service originate from third-party public archives and are presented solely for informational, research, and archival purposes. We make no claim of ownership over any third-party content. All trademarks belong to their respective owners.
7. Content removal (DMCA / takedown)
We respect the intellectual property rights of others. If you are a rights holder (or authorized agent) and believe that material surfaced through the Service infringes your copyright or other rights, you may submit a removal request to the contact address below. Your request should include:
- Identification of the work you claim is infringed;
- Identification of the material on our Service you claim is infringing, with enough detail to locate it;
- Your contact information;
- A statement that you have a good-faith belief that the use is not authorized;
- A statement, under penalty of perjury, that your notice is accurate and that you are authorized to act on behalf of the rights holder.
Because Echo links to third-party archives rather than hosting content, we can both remove the material from our index and point you to the archive that holds the original copy. We review and respond to valid requests promptly.
8. Archival and research purpose
The Service is designed for research, educational, and archival use. The data it indexes was previously collected and made publicly available by recognized archiving organizations operating under their own terms and legal frameworks. The Service acts as a search index over this pre-existing public data; it does not independently scrape or collect content from any platform.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy, completeness, timeliness, or availability of any archived data. Web archives may contain incomplete, outdated, or inaccurate information, and an archive may be slow or offline at any time.
10. Limitation of liability
To the maximum extent permitted by applicable law, Archivarix and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or in connection with your use of or inability to use the Service, regardless of the theory of liability.
11. Indemnification
You agree to indemnify and hold harmless Archivarix and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. You may stop using the Service at any time. Provisions that by their nature should survive termination (including limitations of liability, indemnification, and intellectual property) will remain in effect.
13. Governing law and dispute resolution
These Terms shall be interpreted in accordance with general principles of international commercial practice. Any dispute arising from or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If negotiation fails, the dispute shall be submitted to binding arbitration under the rules of a mutually agreed arbitration body, or, failing agreement, to the competent courts of the jurisdiction where Archivarix maintains its principal place of business.
14. Changes to terms
We may update these Terms at any time by posting the revised version on the Service. The "Last updated" date above indicates when the Terms were last revised. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
